PASSENGER TERMS AND CONDITIONS

This document sets out the terms and conditions applicable for reservation of tickets and/ or tour package through us and you are governed by Malaysian Law. These terms and conditions are subject to change at any time, and we will highlight any alterations here. You will be deemed to have accepted all terms and conditions, if you make a reservation through our website. If you do not agree to these terms and conditions, you may discontinue transaction and log out from this website.

Conditions of Use

1. Warranty No warranty of any kind is given as to the operation of the site, the accuracy of the information or services referred to on the Tourism Malaysia. All warranties are excluded as far as permitted by the law. Neither we nor any third party will be liable for any loss or damage that may result from use of the website or as a consequence of any inaccuracies in, or omissions from the information which it contains. 2. Responsibility We are not responsible for the content of any other website from which you have accessed this website or which you may hyperlink from our website. Further, we are not liable for any loss or damage you incur as a result of your use of any other site from which you hyperlink to or from our website. 3. Availability of Tickets Tickets are subject to availability and general terms and conditions, and to particular terms and conditions that apply to each intercity service. 4. Accuracy of Information We do our best to ensure that the information and fares displayed in our website are correct. Should there be any errors or inaccurate information, we apologies but cannot be held responsible. For email reservation, tour prices quoted online may differ from the price quoted during pickup at the counter or travel agent. 5. In using our website you agree that:- • You will use this website only for your personal use and not for any unlawful or illegal purpose. • You will not modify, transmit or copy or sell or transfer any information or services you may obtain from this website. • You will be responsible for any charges, cost and / or liabilities that arise out of your use of this website. 6. Internet e-mail Messages sent over the internet cannot be guaranteed to be completely secure as they are subject to possible interception or loss or possible alteration. We are not responsible for them and will not be liable to you or anyone else for any damages or otherwise in connection with any message sent by you to us or any message sent by us to you over the internet.

7. Copyright The contents of this site are copyrighted to Tourism Malaysia. No part of this website may be copied, published, broadcast or adapted without our prior written consent.

8. Links to Tourism Malaysia Website Links to this website shall not be setup without written consent from Tourism Malaysia. Requests for linking should be sent to Tourism Malaysia.

9. Other Terms • Ensure that the cookie in your PC is always enabled. • Do not close the browser during reservation process. • For a better performance, we recommend using the latest version Internet Explorer or Netscape browser for this system. • All conditions of carriage contain limitations of liability and you are recommended to obtain copies of these and read them before travelling.

11. Payment and Prices • All fares quoted are subject to availability of seat. • For email reservation, ticket and / or tour prices quoted online may differ from the price quoted during pickup at the counter. • Tickets and / or tour reservation online may only be paid for by the following credit cards: Visa and MasterCard. • Discounted fares or concessions are not applicable for purchase via E-Ticket.

12. Amending your Ticket and / or Tour • Your ticket and / or tour are only valid for the reserved departure. If you have to travel on any other date or wishes to amend your ticket and / or tour, the following conditions are applicable: • Amendments to reserved tickets may be made only once and are subject to term and conditions. • Amendments must be makes 72 days before departure. • Additional charges inclusive of administration cost will be imposed on a passenger for any ticket and / or tour upgrades. • Travel agent will not refund the difference in ticket price if a passenger chooses to downgrade to a lower class. • Reserved ticket is non-transferable.

13. Changes by KTMB If any changes or cancellation are made by KTMB to your booking, KTMB's maximum liability to you will be to refund the price of your ticket.

14. Refunds • Refunds on partially used tickets and or tour are not available. • Travel agent will consider applications for refund only in exceptional circumstances, provided that the application is made in writing (with used and unused portions of ticket and / or tour enclosed) together with reasonable evidence confirming non used of ticket to any KTMB station. • Application for refund of ticket must be made 72 hours before departure.

15. Errors Travel agent accepts no liability for any error in travel details that resulted from incorrect information provided by you at the time of reservation.

16. Lost Tickets and/ or Voucher You are responsible for the safekeeping of your ticket and/ or voucher. If a ticket and/ or voucher are lost or stolen and you can provide the reservation reference ID, we may replace the ticket and/ or voucher for an additional administration charge. Other than this, we will not replace lost, stolen or mislaid tickets and/ or vouchers, nor refund their cost.

17. Restrictions and Liabilities • Tourism Malaysia accepts no liability for the failure of other carriers, tour operators or service providers to perform save in case of death or personal injury resulting from third party’s negligence, our liability will be limited to refunding the price of the ticket and/ or tour you would purchase from travel agent. • Toursim Malaysia accepts no liability for theft, loss of or damage to person, luggage, belongings, effects or any loss caused by a force majeure event. Save as aforesaid, Tourism Malaysia excludes all liabilities to you to the maximum extent permitted by law.

18. Force Majeure Travel agent accepts no liability for any delay, poor performance or failure in performance caused by force majeure and/or matters beyond our reasonable control.

19. Variations These conditions are correct as at the time of print but are subject to variation at any time without prior notice.

All rates displayed are applicable until 2009 unless stated otherwise
